Rachel Murphy, Founding Attorney of Willena, reviewing document

Wondering if it’s time for an update?

I recommend reviewing your plan at least every five years and any time you experience a major life change, for example:

Change in Marital Status

Marriage, divorce, or the loss of a spouse all significantly affect property ownership and decision making.

Marriage: Marriage changes property ownership and default inheritance rules. Your plan should address those changes.

Divorce: Updating ensures your documents no longer name a former spouse as a decision maker or beneficiary.

Widowhood: You may need to adjust ownership, update decision makers, and rethink how and when assets should pass.

Children Growing Up

Welcoming a new child means naming them in your plan and accounting for them in distributions.

As children grow into teens, the guardian who made sense years ago may no longer be the best fit.

And, when that little baby has become a grown adult heading off into the world, they’ll need financial and healthcare Powers of Attorney for themselves.

Buying a Home or Other Real Estate

Real estate is one of those assets that will have to go through probate if you haven’t transferred it into a Trust.

If your plan is Will-based, purchasing property may be the right time to consider a Trust.

If you already have a Trust, it’s critical to make sure new property is properly titled and integrated into your plan.

Starting or Growing a Business

Growing your own business can be very freeing and also adds complexity to your estate planning.

Your plan should ensure the people you’ve named can manage or wind down the business if needed.

If you have a Trust, you need to properly assign your business interests to avoid probate.

Wondering what amending your plan might cost?

I use flat-fee pricing for plan updates, just like with initial planning.
